1 Acceptance of Terms

By downloading, installing, or using Smart Switch: Copy Data (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, regardless of subscription tier. We may update these Terms at any time; your continued use of the App constitutes acceptance of any revised Terms.

2 App Description

Smart Switch: Copy Data is an iOS application developed by Gaming Geek Studio that enables users to transfer personal data — including contacts, photos, videos, and calendar events — between devices. Transfers occur via:

• WiFi Transfer — peer-to-peer over a local network using Bonjour/mDNS (no internet required)
• Link Transfer — via a temporary cloud relay for devices on different networks

The App is available for iPhone and iPad running iOS 15.6 or later. Features may vary between devices and iOS versions.

3 User Accounts & Eligibility

No account registration is required to use Smart Switch: Copy Data. You must be at least 13 years of age to use the App. By using the App you represent and warrant that you meet this age requirement.

You are responsible for ensuring that your use of the App complies with all applicable laws and regulations in your jurisdiction.

4 Subscriptions & Billing

The App offers optional "Smart Switch: Copy Data Pro" subscriptions managed through Apple's App Store:

Free trials automatically convert to paid subscriptions unless cancelled at least 24 hours before the trial ends. Subscriptions auto-renew unless you cancel at least 24 hours before the current period ends. All billing is handled by Apple — Gaming Geek Studio does not process payments directly.

To cancel, go to Settings → Apple ID → Subscriptions on your device. To request a refund, visit reportaproblem.apple.com. We cannot issue refunds directly.

5 Free Tier Limitations

Users without an active Pro subscription may use the App subject to a 2 GB transfer quota. Once this quota is reached, further transfers require a Pro subscription.

The quota is tracked securely and persists across reinstalls via iCloud Keychain. We reserve the right to modify free tier quotas at any time with reasonable notice.

6 Permitted & Prohibited Use

You may use the App to transfer your own personal data between devices you own or control. You agree not to:

• Transfer data belonging to another person without their explicit consent
• Use the App to violate any applicable law or regulation
• Attempt to circumvent transfer quotas or subscription validation
• Reverse-engineer, decompile, or tamper with the App's functionality
• Use the App to distribute malware, spam, or any harmful content
• Interfere with or disrupt the App's services or servers

We reserve the right to suspend or terminate access for any violation of these Terms.

7 Intellectual Property

All content, design, code, trademarks, and intellectual property in the App are owned by or licensed to Gaming Geek Studio. Nothing in these Terms grants you ownership of any intellectual property in the App.

You retain full ownership of any personal data you transfer using the App. By using the App, you do not grant Gaming Geek Studio any license to your personal content.

8 Third-Party Services

The App integrates third-party services including Firebase (Google LLC), Google AdMob, and Adapty. Your use of the App is subject to those services' respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

9 Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAMING GEEK STUDIO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will always be available, uninterrupted, or error-free. We are not responsible for the loss of any data during transfers.

10 Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, GAMING GEEK STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR DAMAGE TO DEVICES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

Our maximum aggregate liability for any claim shall not exceed the total amount you paid for the App in the twelve (12) months preceding the claim.

11 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising out of or related to these Terms shall first be addressed through good-faith negotiation. If resolution cannot be reached informally, disputes shall be resolved through binding arbitration or in a court of competent jurisdiction.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
